JOB Description: 
The LEX Department is a transversal Department responsible for providing support and expertise to other Deps/Dir. and to senior management, as well as to ESMA’s Board of Supervisors and Management Board regarding legal and enforcement matters, ethics, anti-fraud and data protection. It comprises one Unit and one team, respectively in charge of: • providing legal services; and • leading independent investigations. Main duties: ESMA is organising a selection procedure for the post of Legal Officer within the Legal and Enforcement Dept. to fill a post in the Enforcement Team. The jobholder will be assigned to one or several of the below areas under the supervision of the Enforcement team leader. The jobholder will be providing to the Management and the other departments of ESMA sound outcome-focussed legal analysis and advice in the remit of the team, as well as participating in investigations as described above: • Conducting legal research and analysis of case-law, in particular from the European Court of Justice, in matters related to ESMA’s exercise of direct supervisory powers and enforcement action, as well as to ESMA’s breach of Union law powers or on questions relating to professional secrecy matters; • Encrypting, preparing and monitoring access to investigation files in the context of enforcement proceedings; • Contributing to supervisory convergence efforts, in particular through coordinating the work of the Enforcement Network or handling complaints against National Competent Authorities; • Contributing to legal proceedings notably before the Board of Appeal and the Court of Justice of the European Union, in liaison with the Legal Unit.
